Terms of Service & Agreement

This Agreement ("Agreement") is between Evictions Help, LLC ("Evictions Help") and you ("Client" or "Landlord"). By using our services and website, you agree to the terms and conditions outlined herein. If you do not agree, do not use our services.

1. SCOPE OF SERVICES
Evictions Help provides eviction-related services to facilitate the eviction process for landlords. We are not attorneys and do not provide legal advice. Our services include document preparation, court filings, and representation at eviction hearings. By using our services, you acknowledge that no attorney-client relationship is formed.

2. PORTAL ACCESS AND USE
Upon registration, the Client will have access to our online portal to manage eviction services. You agree to:

• Use the portal responsibly and solely for its intended purpose.
• Provide accurate, complete information during the registration process.
• Maintain the confidentiality of your username and password.
• Accept responsibility for all activities conducted under your account.

Unauthorized access or misuse of the portal, including sharing login credentials, is strictly prohibited. Evictions Help reserves the right to suspend or terminate portal access for violations of this Agreement.

3. TERM
This Agreement becomes effective upon the date of the service order and terminates upon the completion of the court trial, unless the Client has purchased additional post-judgment services. If additional services are engaged, this Agreement will continue until those services are completed. Termination does not release the Client from any obligations incurred prior to termination, including payment of fees or indemnification duties.

4. NO REFUND POLICY
All payments to Evictions Help are final and non-refundable. This includes third-party costs (e.g., filing fees, postage) and any fees related to notices or eviction services. Requests for refunds or cancellations must be made in writing and emailed to [email protected]. Evictions Help reserves the right to consider refunds on a case-by-case basis at its sole discretion.

5. PAYMENT AND CREDIT CARD AUTHORIZATION
The Client authorizes Evictions Help to use the provided credit card information for payment of services. This authorization includes recurring charges for services rendered, unless revoked in writing via certified mail. The Client warrants that all credit card information is accurate and that they have the authority to use the card.

6. ACCURACY OF INFORMATION
The Client represents that all documents and information provided to Evictions Help are true, accurate, and authentic to the best of their knowledge. The Client warrants that they are not aware of any conditions on the property that pose health or safety risks to occupants. Any undisclosed facts, unauthentic documents, or contracts requiring additional court appearances may result in an extra $150 charge per additional appearance.

7. INDEMNIFICATION
The Client agrees to defend, indemnify, and hold Evictions Help harmless from any claims, actions, suits, costs, expenses (including attorney's fees), damages, and liabilities related to the property or services provided under this Agreement. This includes any claims arising from inaccurate information or documents provided by the Client.

8. LIMITATION OF LIABILITY
Evictions Help is not liable for any damages, including property damage, personal injury, or consequential damages arising from services provided under this Agreement. Our liability is limited to the amount paid by the Client for services under this Agreement. Evictions Help shall not be responsible for any direct, indirect, incidental, or special damages, including loss of profits or production, whether suffered by the Client or any third party.

9. ADDITIONAL SERVICES AND APPEAL AUTHORITY
If the Client engages Evictions Help for additional services, such as post-judgment services or appeals, additional fees apply. By engaging these services, the Client authorizes Evictions Help to negotiate and settle claims for possession and damages as necessary, in cooperation with the Client’s attorney or an attorney hired by Evictions Help.

10. ENGAGING AN ATTORNEY
If post-trial appeal services are requested, the Client must pay additional fees as shown on our website or in a separate written agreement. Evictions Help may engage an attorney on behalf of the Client, selecting one reasonably believed to serve the Client's interests. Copies of any fee agreements will be provided to the Client upon request.

11. PRIVACY AND DATA HANDLING
Evictions Help respects the privacy of our Clients. All personal information collected via the portal will be handled in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

12. TERMINATION OF SERVICES
Evictions Help reserves the right to terminate this Agreement and/or suspend access to the portal at any time for violations of this Agreement, misuse of the portal, non-payment, or if required by law. Upon termination, the Client’s access to the portal will be revoked, and all data files will be removed from our systems within five (5) business days.

13. ARBITRATION
Any disputes arising out of this Agreement or services provided by Evictions Help will be resolved through binding arbitration. By entering this Agreement, the Client waives the right to a jury trial. Arbitration will be conducted in accordance with the commercial arbitration rules in effect at the time, with costs split equally between Evictions Help and the Client.

14. GOVERNING LAW
This Agreement shall be governed by the laws of the state in which Evictions Help is headquartered. Any legal action arising from this Agreement shall be resolved in the appropriate state court.

15. MODIFICATION
Evictions Help reserves the right to modify this Agreement at any time. Changes will be effective upon posting on our website, and continued use of services will indicate acceptance of the updated terms.

16. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between Evictions Help and the Client, superseding all prior communications. Any amendments must be made in writing and signed by both parties.

17. ADVERTISING
The Client authorizes Evictions Help to share their contact information with service providers reasonably believed to assist with their real estate needs, excluding property management companies.

18. ATTORNEY'S FEES
Evictions Help is entitled to recover reasonable attorney's fees incurred in enforcing this Agreement or addressing any breaches by the Client.

19. USE OF PORTAL AND INTELLECTUAL PROPERTY
The Client agrees to use the portal solely for its intended purpose and not to infringe on Evictions Help's intellectual property rights. Any misuse of the portal, including using it for purposes other than managing eviction services, may result in immediate suspension of services.
